MixedBySimeon – Terms & Conditions

1. Scope of Services & Deliverables

MixedBySimeon (“the Engineer”) provides recording, production, mixing, remixing, and/or mastering services as agreed with the Client. Exact services, pricing, and turnaround timelines will be confirmed in writing prior to project commencement. Turnaround times are estimates, not guarantees.

2. Payment Terms & Deposit

·      A £25 non-refundable deposit is required to secure all studio bookings, including flat‑rate packages or credits.

·      The session may be rescheduled, with the deposit carrying over if requested with 72 hours notice.

·      New clients may do a 2 hour trial session for £50 to assess the quality before committing to full sessions.

·      Projects under £5,000 require full payment upfront before final delivery.

·      Projects £5,000 and above: 50% upfront and 50% upon completion, prior to delivery of final files.

·      For studio cancellations, rescheduling, or unattended bookings with fewer than 72 hours’ notice, the session fee will be lost. This reflects the Engineer’s loss of reserved studio time and the inability to rebook the slot at short notice.

·       A free draft mix is available for new clients to demonstrate the power and quality of MixedBySimeon, prior to purchasing.

3. Revisions

·       Mixing services include 10 revisions.

·       Revisions do not include major creative direction changes.

·       Major creative direction changes include altering the overall vibe, arrangement, or replacing previously approved elements.

·       Each revision incorporates multiple edits.

·       Additional revisions available at £25 per revision.

·       Revisions relate to the existing mix and do not include substantial re-arrangement, re-production, or addition of new files.

·       Revision requests must include written timestamps and specific details (elements/lyrics).

·       Submit via WhatsApp or email using this format: > Edit number > change > timestamp.

·       Revisions must be requested within 28 days of delivery.

·       Revisions requested after 28 days may incur additional charges and are at the Engineer’s discretion

4. Credits (Mandatory Credit Clause)

·       The Client agrees to provide proper credit wherever the Work is published or distributed.

Required credit format: > Mixed By Simeon (@MixedBySimeon)

·       If credit is missing, the Client will receive written notice and has 7 days to correct.

·       Engineer reserves the right to refuse future work until credit is corrected.

5. Ownership, Copyright & Licenses

·       Upon final payment: - The Client owns 100% of the Master Recording and any associated publishing rights unless a rights‑based discount has been granted (see Section 7).

·       The Engineer retains a non‑exclusive perpetual license to reference and showcase the work in a portfolio, website, showreel, social media, or advertisements.

·       Mix project files, templates and session files remain the intellectual property of the Engineer.

·       Stems for the final approved mix are included at no additional cost if requested within 6 months.

·       Project files may be supplied at the Engineer’s discretion for an additional fee (proprietary plugins may be removed/inactive).

·       Project files are delivered “as is” without support

·       Clients can request stems anytime within 6 months of the date of completion.

·       After 6 months, a standard hourly fee of £60 will apply.

6. Delivery Format & File Responsibilities

·       A draft mix will be delivered first - the Client is encouraged to test across multiple systems and gather feedback.

·       Once approved, the mix is sent for mastering.

·       Standard delivery format: - 44.1 kHz / 16‑bit WAV final masters (digital download)

·       Source files delivered at other sample rates/bit depths will be converted to 44.1 kHz / 32‑bit float for processing

·       The Client is responsible for downloading and storing files promptly. Files are stored for 12 months after project delivery - Backups not guaranteed beyond this period.

·       The Engineer is not responsible for corrupted, lost or inaccessible downloads once files have been delivered

·       Delivery is deemed complete when the download link is sent

·       Longer term storage 1-5 years can be arranged for a fee of £100/year.

·       All alt mixes included as standard: Radio edit, PA Mix, Instrumental & Acapella

·       Alt mixes included as standard are basic versions: Words cut out for radio edit (silent gaps), PA mix is all backing vocals with no lead

·       Custom radio edits or PA mixes outside of these specifications will be charged at £50 each

7. Label / Major Release / Rights‑Based Pricing

·       Listed prices apply to independent artists.

·       If the project involves a label, publishing company, commercial placement, or significant release (e.g., radio playlisting, film/TV sync, major playlist support), a separate agreement may be required.

·       Where discounts or special pricing are granted, ownership of: - Master Rights and/or - Publishing Rights may be negotiated in exchange for reduced pricing.

·       No ownership changes apply unless agreed in writing.

·       Major release status is determined at the Engineer’s discretion.

8. Client Obligations

·       The Client confirms that: - All audio, samples, and creative content provided are used with legal permission. They will respond promptly and provide required materials to meet agreed timelines.

·       The Client indemnifies the Engineer against all claims arising from unauthorised samples or content.

The Engineer is not responsible for distribution issues, sample clearance, or third‑party copyright claims.

9. Limitation of Liability

·      The Engineer shall not be liable for: - Any indirect or consequential loss - Commercial performance of the music - Loss of data following delivery

·      Liability is limited to the value of the services purchased.

·      Nothing in this agreement limits liability for death, personal injury or fraud.

10. Dispute Resolution & Governing Law

·      Any disputes shall first be attempted to be resolved amicably via written communication. If unresolved, disputes are governed by UK law under the exclusive jurisdiction of UK courts.

11. Privacy & Data Protection

·      MixedBySimeon collects and stores the Client’s contact information (name, email address, and telephone number) solely to communicate, deliver services, transfer files, and invoice. Data is handled securely in accordance with UK GDPR. The Client may request deletion or access to data at any time by emaling mixedbysimeon@gmail.com.

·      Our lawful basis for processing data is: (1) performance of a contract, and (2) legitimate interest.

·      Client contact information is retained only for as long as necessary to provide services and maintain basic business records. It is never sold or shared with third parties.

12. Acceptance of Terms

By booking sessions, submitting tracks for mixing/mastering, or paying any deposit or invoice, the Client accepts and agrees to these Terms & Conditions.
